The conflict of interest rules that apply to public servants working in government ministries also apply to public servants appointed to or employed by public bodies. These rules are set out in Ontario Regulation 381/07 under the Public Service of Ontario Act, 2006 (PSOA).

The PSOA allows public bodies to develop their own rules for the commissioner's approval. To be approved, these rules must, at a minimum, meet the ethical standard set by regulation.

In some cases, the approved rules only apply to a specified group of public servants in the public body (e.g., appointees). In such cases, the rules in Ontario Regulation 381/07 apply to all other public servants in that public body.

Approved rules take effect once published on the commissioner's website.

Public Bodies' Approved Rules

The Office of the Conflict of Interest Commissioner has developed a series of fact sheets for public servants who are seeking the commissioner's assistance. Each fact sheet sets out a specific responsibility of the commissioner as prescribed in the Public Service of Ontario Act, 2006 and discusses how each responsibility is carried out. The fact sheets are intended to ensure a common understanding of the scope of the commissioner's responsibilities.

All public servants are subject to political activity restrictions pursuant to the Public Service of Ontario Act, 2006. In order to assist ethics executives in applying these political activity restrictions, the Office of the Conflict of Interest Commissioner has developed two roadmaps. One applies to specially restricted public servants and the other applies to all other public servants.

Each year, the Conflict of Interest Commissioner's annual report includes a selection of summaries of the conflict of interest and political activity questions or issues dealt with during the year. These summaries are intended to assist Ontario public service decision-makers in interpreting conflict of interest and political activity rules and applying the rules to similar situations.

    This tool is to be used by public bodies that choose to submit conflict of interest rules or revised rules to the Conflict of Interest Commissioner for approval.

    These rules should use the language and format of Ontario Regulation 381/07 to the extent possible.

    Conflict of Interest Declaration Form 
    This form is to be used by public servants* or their supervisors to request advice or a determination from the public servant's ethics executive or to notify their ethics executive of a personal or pecuniary interest that could raise an issue under the conflict of interest rules.

    * While the form is intended for public servants in ministries, public servants in public bodies, both employees and appointees, may use and modify this form a required.
